Devendra Fadnavis Takes Oath at BJP's Friday Blockbuster

  Devendra Fadnavis, 44, is Maharashtra's new chief minister. He took oath today along with nine ministers at a grand ceremony at Mumbai's Wankhede stadium, filled to capacity.

Among the new Maharashtra Cabinet ministers are Pankaja Munde, who drew an electric applause as she came up to take oath, and Maharashtra BJP veterans Vinod Tawde and Eknath Khadse.

Prime Minster Narendra Modi attended the function and was seated along with other VIPs on a separate stage. The invitee list of 30,000 included actors Amitabh Bachchan, Shahrukh Khan and Aamir Khan and industrialists like Ratan Tata and the Ambani brothers.

Five people away from the PM sat Shiv Sena chief Uddhav Thackeray, who arrived late and missed Mr Fadnavis' oath. As he walked to his seat, he stopped to greet the Prime Minister. They shook hands and exchanged a few words.

Mr Thackeray made a last-minute decision to attend the function after BJP president Amit Shah allegedly phoned him and requested his presence. The Shiv Sena had announced a boycott of the swearing-in after the BJP rejected the demand that its leaders be included in the small cabinet that took oath today.

"Uddhav coming is a big step...we urged him to attend the swearing in ceremony... Our talks are on and are in the right direction," Mr Fadnavis said this evening, addressing his first press conference as chief minister.

The BJP is in talks with the Shiv Sena to renew the 25-year alliance they snapped in September.

Mr Fadnavis, the BJP's first Maharashtra chief minister heads a minority government and has to prove his strength on the floor of the Assembly within 15 days.

The Shiv Sena - which has been out of power in Maharashtra for 15 years and fears major erosion in party base if it does participate in the government - has expressed its desire to provide that support in tones ranging from aggressive to coaxing; the BJP has so far only said that it hopes negotiations will come to fruition. It has reportedly made clear that it will entertain no pre-conditions for the support of its former ally.

The NCP has offered external support to the BJP, but the latter will be wary to accept or count on it.

A Fatal Crash Is Latest Setback for Commercial Space Industry

 SpaceShipTwo, a rocket plane that was meant to carry well-heeled tourists on short if expensive rides to space, crashed in the Mojave Desert on Friday during a test flight, killing one of the two pilots.

The pilots, who have not yet been identified, were flying the plane for Virgin Galactic, the space tourism company created by the entrepreneur Richard Branson, and Scaled Composites, the company that designed and built the plane.

One pilot was able to parachute from the plane and was taken to a nearby hospital with "moderate to major injuries," said Ray Pruitt, the public information officer for the Kern County Sheriff's Office in California.

The test was the first time SpaceShipTwo had flown using a new, plastic-based rocket fuel.

It was the second major accident in a week for the commercial space industry, which has been widely promoted in recent years as an alternative to costly government programs. On Tuesday, an unmanned rocket launched by Orbital Sciences Corp. of Dulles, Virginia, which was carrying cargo to the International Space Station, exploded 15 seconds after launching.

SpaceShipTwo and Orbital's rocket are very different in design and purpose, but both are part of an effort to bring private investment into the space business, until now largely the realm of government agencies like NASA and the military.

Virgin Galactic, which hoped to begin tourist flights next spring, already has more than 700 reservations, initially sold for $200,000 a seat before rising to $250,000 last year.

The list of would-be astronauts includes celebrities like Leonardo DiCaprio, Justin Bieber and Angelina Jolie.

Experts said it was too soon to tell when the effort would resume.
"Virgin was out ahead of everyone else for space tourism," said Michael Blades, the aerospace and defense industry senior analyst at Frost & Sullivan, a market research and consulting firm. "It will still happen, but it has been pushed way to the right.

"It is just like any kind of other new technology, especially when it comes to flight," he continued. "You have your tests and you have your failures."

Friday's accident took place tens of thousands of feet above the desert. As planned, SpaceShipTwo was carried aloft by a larger plane, WhiteKnightTwo, then dropped at about 50,000 feet. In a tourist flight, SpaceShipTwo's rocket engines would take it to the 62-mile-high boundary defined as the edge of space.

After the smaller plane was released, its motor ignited. The accident appeared to happen 60 to 90 seconds later, said Stuart Witt, the chief executive of Mojave Air and Space Port, where WhiteKnightTwo took off at 9:18 a.m. Pacific time.

"I knew something was wrong," he said. "I didn't know what. It wasn't obvious at first."

A radio call reported an anomaly. "And we waited," he said.
The sheriff's office received a call after 10 a.m. that an aircraft had gone down about 20 miles northeast of the city of Mojave. "We have located a debris field," Pruitt said.

WhiteKnightTwo landed safely.

Via Twitter, Branson said, "I'm flying to Mojave immediately to be with the team."

Virgin Galactic grew out of the success of the Ansari X Prize contest in 2004, for the first privately built and financed craft that could rise above the 62-mile boundary of space. Scaled Composites won the $10 million prize with a smaller version of SpaceShipTwo, an effort financed by Paul Allen, the co-founder of Microsoft.
Immediately after the X Prize, Branson announced his plans for a spaceship that would carry two pilots and six passengers on suborbital flights - in which the plane does not go into orbit but offers a few minutes of weightlessness at the top of an arcing trajectory.

Over the years, Branson has repeatedly said he hoped commercial flights would begin soon. This is the second time tragedy has struck the spaceport in connection with Scaled Composites; in July 2007, a rocket system test went awry, killing three people.

Most recently, he said that with the resumption of powered test flights, he hoped the first commercial flights would take off next spring. He and his family plan to be the passengers on the first operational flight.

Although SpaceShipTwo had flown 54 previous test flights, all but three were unpowered tests in which it glided to the ground. This was the fourth time its motor was ignited.

In May, Virgin Galactic announced it was switching to the plastic-based fuel from the rubber-based one it had used. Friday's flight was the first powered by the new motor.

The previous version was problematic, causing strong vibrations in the spacecraft. In an article published last month in Popular Mechanics, Brian Binnie, a former test pilot for Scaled, said, "We had start-up instabilities and we had end-of-burn instabilities."
While troubleshooting the problem, "we did everything but break down and pray to God to show us the light of day," said Binnie, who has now moved to XCOR Aerospace, another company at Mojave that is building a suborbital space plane for tourists.

Marco Caceres, director of space studies at the Teal Group, a consulting firm, said that "in an age where it is very expensive to fly these vehicles, the pressure is to do the minimal amount of test flying.

"So that may be something we have to take a look at," he continued. "Everyone seems to be in need of more money to conduct more flights, so the pressure is to start operational flight too soon. Maybe we are being unreasonable here."

Patricia Hynes, director of the New Mexico Space Grant Consortium, who organizes an annual symposium for people in the commercial space industry, said the accident "helps people understand why it's never been done before."

"This is a tough business," she said.

Hynes has bought a Virgin Galactic ticket, and the news did not change her intention to fly. "No, absolutely not," she said.
A second SpaceShipTwo plane is currently under construction.

Uddhav Thackeray Accepts One Invite in Hope of Another

 Uddhav Thackeray, the top leader of the Shiv Sena, was a little late to the BJP's blockbuster inaugural ceremony in Maharashtra today. That meant he missed Devendra Fadnavis of the BJP taking oath as the new Chief Minister. But his presence signaled the possible denouement of the melodrama that his party and the BJP have inhabited since September, when they ended a 25-year alliance.

At the event, Mr Thackeray shook hands with Prime Minister Narendra Modi, whom he had aggressively caricatured in the election campaign. Mr Thackeray had initially RSVP-ed for today's ceremony - his party bemoaned serial "humiliation" by the BJP - but a last minute call from BJP President Amit Shah led him to Wankhede Stadium in Mumbai. 
 "His being there was a big step. Our talks are moving in the right direction," said new Chief Minister Fadnavis to reporters this evening.

Since the BJP won the election earlier this month, the Sena has been on stand-by for a reunion. In its best-ever performance in Maharashtra, the BJP won the most seats, but not a clear majority. As runner-up, the Sena could have played a crucial role in bridging. But its leverage was neutered by Sharad Pawar, who said his party would support a minority government.

Since then, the Sena has abandoned playing it cool. This week, leaders told the BJP that they should be included in the first edition of the cabinet that was sworn in today. Omission, the Sena felt, would be too rugged a rebuff to palatably ignore as negotiations continue. The BJP did not yield.
   
In the Sena mouthpiece that was enlisted during the campaign to pillory the BJP, recent editorials have paid compliment to the PM and Mr Fadnavis. Today's column defended the BJP from the opposition's allegations of an over-extravagant spectacle. "It's laughable to hear criticism from those who supervised the loot of the state," the Sena newspaper said.

Petrol Price Cut by Rs. 2.41 Per Litre, Diesel by Rs. 2.25

  Petrol price was on Friday cut by Rs. 2.41 a litre, the sixth reduction since August, while that of diesel was slashed by Rs. 2.25 per litre on back of falling international oil rates.

The reduction in rates of petrol and diesel, which was deregulated for the first time in more than a decade, will be effective from the midnight of October 31 and November 1, Indian Oil Corp, the nation's largest fuel retailer, announced.

The Rs. 2.41 a litre price cut in petrol and Rs. 2.25 in diesel was after accounting for an increase of 10-15 paise in commission paid to petrol pump dealers. The reduction should have been higher by 10-15 paise if the dealer commission had not been increased.

Petrol will cost Rs. 64.25 a litre in Delhi from Saturday as against Rs. 66.65 currently. In Mumbai, the rate will be lowered by Rs. 2.55 a litre to Rs. 71.91.

Since August, petrol price has been cumulatively slashed by Rs. 9.36 per litre.

Prices vary from state to state because of differential rate of local sales tax or VAT.

Diesel rates have been cut for the second time this month. The nation's most consumed fuel will now cost Rs. 53.35 per litre in Delhi from Saturday as compared to Rs. 55.60 a litre at present.

In Mumbai, diesel price has been reduced by Rs. 2.50 to Rs. 61.04.

The government had on October 18 freed diesel prices from its control, giving freedom to oil marketing companies to adjust rates in line with cost. On that day, rates were cut by Rs. 3.37 per litre, the first reduction in price of diesel in over five years.
 The previous decline dates back to January 2009.

Simultaneously, the price of non-subsidised cooking gas (LPG) was cut by Rs. 18.5 to Rs. 865 per 14.2-kg cylinder.

Since August, this is the fourth reduction in rate of non-subsidised LPG which consumers buy after exhausting their quota of sub-market priced domestic cooking gas.

Non-subsidised LPG in Delhi was priced at Rs. 922.50 in July and rates have in every subsequent month been reduced. The only exception being October 23 when the prices rose by a marginal Rs. 3 per cylinder following government raising the commission paid to LPG dealers/distributors.

"The price of petrol was last revised downwards with effect from October 15 by Rs. 1.21 per litre (including state levies at Delhi) on the back of declining international oil prices," IOC said in a statement.

The government decided to make diesel prices market-determined for all consumers on October 18, it added.

"Subsequently, with effect from October 19, based on prevailing level of international prices and Rupee-USD exchange rate, the selling price of diesel in domestic market was reduced by Rs. 3.37 per litre (including state levies at Delhi) with corresponding decrease in other states."

Since then, international prices of petrol and diesel have continued to be on a downtrend. But foreign exchange rate has appreciated slightly.

"The combined impact of both these factors warrant the said decrease in retail selling prices of petrol and diesel," the statement added.

IOC also said it was "closely monitoring" prices in the international oil market and rupee-dollar exchange rate, and that developing trends of the market will be reflected in future price changes.

Teacher Arrested for Allegedly Raping Six-Year-Old in Bangalore School

  A teacher in Bangalore has been arrested for allegedly sexually assaulting a six-year-old child in school this week, the fourth such case in the city since July.

The police say the teacher has confessed to the crime. The child, a student of Class 1, was allegedly assaulted twice, on Tuesday and Wednesday, said senior police officer Alok Kumar. "This person has been a teacher in the school for long," he told NDTV.

The child allegedly came home and complained of pain. She was taken to a doctor who reportedly confirmed that she had been sexually assaulted. A rape case was registered yesterday. The teacher was questioned on the child's mother's complaint.

"These cases are taking place particularly in private schools and we have issued circular to the management of the private school that they have to take care of this. We will take note of this and will act on this," Chief Minister Siddaramaiah said today.

A group of political activists today gathered outside the school and protested.

This case has emerged a week after a nursery student was allegedly sexually abused at another school in the IT city. The three-year-old child was allegedly attacked on October 21, last Tuesday. On the chief minister's orders, the police filed a criminal case against the school.

The same day, a charge-sheet was filed in the attack on a six-year-old girl at the Vibgyor International School in July - the first case that highlighted the grossly inadequate security in schools in Bangalore. The two gym instructors arrested in the case have been charged with gang-rape and destruction of evidence.

The police recently came up with a set of guidelines for child safety in schools - which included keeping CCTV cameras in schools and GPS in school buses. These rules were to be followed by August-end, but last month, nearly 200 schools were booked for not doing so.

The school involved in the latest incident has also not put in place safety measures, the police said.

  Prime Minister Narendra Modi was at the centre of a massive commemoration today of the birth anniversary of Sardar Vallabhbhai Patel, India's first Home Minister, who belonged, like Mr Modi, to Gujarat. 

"Without Sardar Patel, even Mahatma Gandhi seems incomplete. It was a unique partnership that strengthened the struggle for independence," the Prime Minister said after he placed flowers on a statue of Sardar Vallabhbhai Patel in Delhi near parliament.

Dressed in a white kurta pyjama with a red shawl, Mr Modi then walked briskly down one of Delhi's main roads, flagging off a countrywide "Run for Unity" with thousands of participants by his side
Since taking office, Mr Modi's government has said Sardar Vallabhbhai Patel's birth anniversary will be celebrated ever year as Rashtriya Ekta Diwas or "National Unity Day."

Today is also the 30th death anniversary of former Prime Minister Indira Gandhi, whose assassination by her Sikh bodyguards in 1984 triggered riots in which thousands of Sikhs were killed in the capital.  In his speech, Mr Modi referred to Mrs Gandhi's death anniversary; later, he described the communal violence that followed her death as "a dagger into the heart of thousands of years of country's heritage and culture."

Some senior Congress leaders have been accused of instigating the mobs that led the riots, and the party has been criticised for not penalising them.

The PM and his party, the BJP, have accused the Congress of ignoring the legacy of Sardar Patel as a founding father of the country and promoting only the Nehru-Gandhi dynasty. Stung, the Congress has said that the PM should remember and acknowledge that Sadar Vallabhbhai Patel was a Congressman.

Mr Modi's government has said it will provide $33 million or Rs. 3000 crore towards the construction of a massive statute in Gujarat of Sardar Patel, intended to be twice as tall as that of the Statue of Liberty.

'1984 Riots a Dagger Through India's Chest': PM Narendra Modi

  Prime Minister Narendra Modi today said the anti-Sikh riots in the aftermath of Indira Gandhi's assassination were like a "dagger that pierced through India's chest."

Speaking at the "Run for Unity" to mark Sardar Vallabhbhai Patel's birth anniversary - seen as the BJP government's attempt to recast a day traditionally marked as Indira Gandhi's death anniversary - PM Modi said, "Our own people were murdered, the attack was not on a particular community but on the entire nation. It was like a dagger pierced through India's chest."

Over 3,000 people, mostly Sikhs, were killed after then prime minister Indira Gandhi was shot dead by her own Sikh bodyguards at her home in Delhi. The killing was linked to Mrs Gandhi's decision to sanction "Operation Bluestar", or the storming of the Golden Temple to flush out Sikh militants hiding there.

Allegations that the Congress tried to protect its top leaders accused of leading mobs against Sikhs have been a recurring theme in the BJP's campaigns against the UPA.

"It is unfortunate that on the birth anniversary of the man who dedicated his life in uniting the country, a tragic incident took place 30 years ago that shook the country and left it deeply scarred," PM Modi said.

In what many in the Congress see as an "insult",  there was no one from the central government at Indira Gandhi's memorial Shakti Sthal today for a tribute organized by Sonia Gandhi, her daughter-in-law and Congress president.
PM Modi had tweeted his tribute in the morning, saying, "I join my fellow countrymen & women in remembering former PM Smt. Indira Gandhi on her Punya Tithi (death anniversary)."

President Pranab Mukherjee and Vice President Hamid Ansari were the only dignitaries to join the homage for Indira Gandhi, besides Congress leaders including Sonia and Rahul Gandhi.

Congress leaders say it is the first time that Indira Gandhi's death anniversary was marked without any state patronage.

 When the BJP's first government in Maharashtra is sworn in tomorrow, former ally Shiv Sena will be confined to the role of spectator. "No Shiv Sena leader will be inducted," said BJP General Secretary Rajiv Pratap Rudy today, though he added that negotiations continue for a possible reunion.

The BJP has planned a mega-inauguration for a mini-cabinet headed by Devendra Fadnavis as Chief Minister. The Sena and the BJP cut a 25-year alliance ahead of the election, with the Sena bearing monumental costs for the split. The BJP accrued its best-ever result, and though the Sena placed second, it has been filched of the chance to play king-maker

 The BJP has resolutely refused to hit the gas pedal in the negotiations for a reunion, not least to exact revenge for a vicious campaign that saw its top leaders being pilloried by  Sena chief Uddhav Thackeray. This evening, sources said Mr Thackeray will skip tomorrow's inaugural; some of his colleagues reportedly feel that their exclusion from the first cut of the government is a public insult.

But the Shiv Sena can do little than mark its protest with a no-show. The BJP won the most seats but not a clear majority, and yet, it faces no discomfort. Sharad Pawar's party, the NCP, has said it will support a minority government; a handful of independents are also willing to align with the BJP.

That has forced the Sena to marshal uncharacteristic pliancy. China Chides India over New Border Posts in Arunachal Pradesh

  China's Defence Ministry cautioned India on Thursday over plans to construct 54 new border posts along the border in Arunachal Pradesh.

"We urge the Indian side to do more to maintain peace and stability in the area and not do things that may complicate the situation," said Defence Ministry spokesman Yang Yujun.

In September, Indian and Chinese troops faced off along the border in Ladakh, even as President Xi Jinping was in Delhi to meet with Prime Minister Narendra Modi and both leaders pledged to boost economic cooperation and substantially increase Chinese investment in India's infrastructure.

India also recently announced plans to build a new 2000-kilometre road in Arunachal to keep up with China's development of transport links and airstrips on its side of the Line of Actual Control.  Delhi has also announced Rs. 175 crores which will be spent on improving infrastructure along the border.

Asked why China is wary of that, its Defence Ministry spokesman said, "I think that
the roads you are talking about are in the eastern part of the China-India border which is still a disputed area."

Am Inviting Pakistani Premier But Not PM Modi, Says Shahi Imam

  One of India's top Muslim clerics has invited Pakistan Premier Nawaz Sharif but not Prime Minister Narendra Modi for a ceremony that will see his son being appointed as his successor as the Shahi Imam of the country's largest mosque.

"The host decides who to invite. And I have no place for Modi in my heart. Modi has not done anything for Indian Muslims even after coming to power. Indian Muslims have not forgiven him for the 2002 Gujarat riots," said Syed Ahmed Bukhari of the famous Jama Masjid in Delhi. Before the national election, he endorsed the Congress party, which emerged with its worst-ever result.

Four senior BJP leaders including Home Minister Rajnath Singh have been invited for dinner on November 29 to mark the occasion, he added, along with Congress President Sonia Gandhi and her son, Rahul.

"We have invited the prime minister of Pakistan as we have had relations with him since my father's time," Mr Bukhari told news agency IANS. In May, the Pakistani Prime Minister visited the Jama Masjid while in Delhi to attend Mr Modi's swearing-in ceremony.

19-year-old Shaban Ahmed Bukhari, will be officially anointed the 14th Naib Imam or imam-in-waiting on November 22.

Black Money Case: List of 627 Foreign Account Holders Given to Supreme Court

A list of 627 Indians with bank accounts at HSBC in Switzerland has been given in a sealed envelope to the Supreme Court, which yesterday sharply rebuked the government for its handling of attempts to recover untaxed or black money stashed abroad. "We can't leave the issue of bringing back black money to the government. It will never happen during our time," the judges said.

The court set a deadline of March 2015 to complete the probe into whether these account holders have violated tax laws. In a signal that it does not intend to disclose the names, the Supreme Court said the list will be given to the top officials of a panel it has set up of retired judges and regulators to map the recovery of black money.
 The previous Congress government and the new BJP administration have both argued in court that tax treaties with other countries prohibit the disclosure of names till charges are framed. Judges today told the government to present any reservations to its Special Investigation Team (SIT). "It said we must place problems before the SIT for further negotiations on treaties and any economic impact," said Attorney General Mukul Rohatgi.

The government says that the list given today includes some who may have legitimate accounts abroad. Sources say that in the next few weeks, the Special Investigation Team will submit a report on 220 HSBC account holders to the court.

The Supreme Court has been monitoring the black money investigation since 2009 based on a petition by noted lawyer Ram Jethmalani.

Along with the list of account holders, the government has reportedly submitted communication with French officials, as well as a status report on its investigation so far. In 2011, France gave Delhi a list of Indians who have bank accounts at HSBC in Geneva - the data was provided by a bank employee who turned whistle-blower.

Explosion Leaves Questions and Dead Mosquito Eggs

No people were hurt when a rocket taking supplies to the International Space Station exploded just after launching on Tuesday night - but the mosquito eggs did not survive.

Julia Ellis, 13, was across the bay from the launching pad on Wallops Island, Virginia, less than 2 miles away, watching as the rocket lifted off. Amid the 5,000 pounds of cargo was an experiment that she and four classmates at Columbia Middle School in Berkeley Heights, New Jersey, had devised to study whether mosquito larvae can grow in zero gravity.

"Everyone was just so excited and happy," she said. "You could hear everyone cheering."

Then there was a flash, and the rocket fell. "It feels like someone smacked you in the chest," she said. "You hear one small explosion, one really large explosion and then two small explosions."

On Wednesday, investigators started looking through the wreckage of the Antares rocket, built by the Orbital Sciences Corp. of Dulles, Virginia, one of two private companies that NASA relies on to take cargo to the station. Four previous Antares launches, three of which went to the space station, were successful.

During a conference call with financial analysts, David W.

Thompson, Orbital's chairman and chief executive, said the rocket experienced a catastrophic failure about 15 seconds after liftoff, destroying the rocket and its payload. "It appears that the launch complex itself was spared from any major damage," he said.

Garrett E. Pierce, the company's chief financial officer, said the failure would not affect the company's finances this year, because insurance would cover repairs to the launching site and the payments from NASA that might be held back.

Orbital has a $1.9 billion contract from NASA for eight cargo flights, or $237 million each.

NASA officials said the loss would have no immediate effect on the operations of the space station, which has several months of supplies. A Russian cargo rocket successfully launched on Wednesday, as scheduled, and docked at the space station six hours later.

Among the items lost in the Antares explosion were a suite of student experiments arranged by NanoRacks, a small company in Houston that flies commercial payloads to the space station. Also lost were 29 nanosatellites, the largest weighing about 22 pounds, that the company had arranged to be launched from the space station.

Jeffrey Manber, NanoRacks' managing director, spent the day like an airline customer service agent trying to rebook passengers from a canceled flight.

"We're sitting here right now working through the needs of our customers," Manber said. "What are the priorities of the payloads? Who can rebuild? Who's ready to go?"

SpaceX, the other company that NASA has hired to ferry cargo, completed its most recent flight to the station last week, and its next rocket is scheduled to launch in December. Manber said some of the rebuilt student experiments could be on that flight.

Thompson said he expected that the next Antares launch, set for April, would be delayed by several months.

While he said it was too early to speculate on why the Antares crashed, Thompson added: "It will likely not take very long - I think a period measured in days, not weeks - for the investigation team to define the handful of most likely causes of the accident. It may take a little longer than that to zero in on the final root cause."

Certain to be scrutinized are the two engines in the rocket's first stage. They were built in the Soviet Union in the late 1960s and early 1970s to power a giant rocket to go to the moon. After NASA's successful moon landings, the Soviets abandoned their effort, and the engines lay in storage for decades.

Then a U.S. company, Aerojet, bought and refurbished them, and Orbital incorporated them into the Antares design.

One of the engines failed during testing in May, delaying the previous Antares flight. Orbital officials said the company was considering accelerating its plans to replace the old Soviet engines.

Orbital has had two other high-profile NASA failures in recent years.

In 2009, NASA's Orbiting Carbon Observatory on top of Orbital's Taurus XL rocket was lost when the nose cone protecting the satellite failed to separate, and the satellite crashed into the ocean.

Two years later, a similar failure destroyed NASA's Glory satellite, which was to have made climate observations.

Billions of Dollars in Black Money? Think Much Smaller, Say Sources

While the government has submitted a list of 627 Indians who hold accounts at HSBC to the Supreme Court today, sources in the tax department say that the black money that the government can hope to recover - including penalties - is Rs. 3,000 crore, an amount that greatly dampens talk of billions of dollars that could be brought back to India.

Officials familiar with the list of account holders given today to court present a series of challenges that await the government.

Of the 600-odd account holders, about 150 have paid taxes or penalties already since the names were handed over to India a few years ago. Their cases must be treated as settled, said sources, and they cannot be prosecuted now.
 On an average, the accounts hold about 40-50 crores each, said sources. A few tip the scales with a balance of between 500 and 1,000 cores, but they are held by trusts in tax havens, and do not list individuals' names. Income tax officials say they have failed to uncover the beneficiaries of these trusts.

At least 120 Indians on the list have denied holding any account abroad - those claims are tough to disprove. Income tax officials cannot ask HSBC to verify them because the list of account holders was leaked by a French employee at the bank's Geneva branch. Swiss officials say the data is stolen and cannot comment on it. However, recently, Delhi managed to persuade them to share some information on those Indians against whom evidence has already been collected at home. 

Raids on account holders are untenable; income tax officials say they cannot justify these legally because they don't have enough evidence or information to merit searches.

Sources say India is trying to get from Germany a fresh list of 8,000 accounts held in Switzerland, but negotiations are stalled over concerns that Delhi will violate key confidentiality clauses - tax treaties with foreign countries forbid the disclosure of names before charges are framed.

The Supreme Court has been monitoring plans to recover black money since 2009 on the request of lawyer Ram Jethmalani. In addition to the HBSC list, which was given to India by France in 2011, Germany has supplied a list of 18 Indians with accounts in Lichtenstein.

The court has described as inadequate the progress made by the previous Congress government and the new Modi administration; it has asked a special team it formed of former judges and regulators to now examine the list of foreign account holders and determine the course of action.

Significantly, the court has made it clear that it will not release the names for now.

PM Narendra Modi May Join 'Run for Unity' on Sardar Patel's Birth Anniversary

  Prime Minister Narendra Modi is expected to join a run as part of a series of events planned for October 31, the birth anniversary of his idol Sardar Vallabhbhai Patel.

The new government has grand plans to celebrate the day as "Rashtriya Ekta Diwas" or National Unity Day, as a tribute to India's first home minister. When the Congress-led UPA was in power, October 31 was largely marked by obituaries and tributes to former prime minister Indira Gandhi, who was assassinated by her security guards in 1984.

Officials say a large number of young people and schoolchildren will participate in the run to be organised across major cities, districts and towns.
PM Modi is expected to join the run in the heart of Delhi on Rajpath, a tree-lined avenue between India Gate and the presidential palace Rashtrapati Bhawan.

A pledge ceremony is also likely to be organised in all government offices.

PM Modi has repeatedly been accused by the Congress of trying to appropriate the legacy of Sardar Patel, a lifelong Congressman.

After taking charge, the 64-year-old prime minister has included other Congress icons in his campaigns.

The "Swachh Bharat" or Clean India mission was launched on Mahatma Gandhi's birth anniversary. PM Modi said the campaign would be taken to schools in a big way on former Prime Minister Jawaharlal Nehru's birth anniversary on November 14.

Last year, Mr Modi had organised a similar array of events to mark the death anniversary of Sardar Patel in Gujarat, the state he ruled for 14 years till May, when he took over as prime minister. A "Run for Unity" marathon held at over 1,100 locations became a major mobilisation event for the BJP in the months before the national election.

Arrested in Andhra Pradesh for "Love You Hudhud" Facebook Post

  "What's on your mind" must be answered very carefully on Facebook, as a man in Andhra Pradesh discovered today. He has been arrested for posting, three days after Cyclone Hudhud devastated the city of Visakhapatnam - "I love you Hudhoodh. For nature having selectively punished those who cheated - feeling God is there".

He wrote partly in English and partly in Telugu.

The Andhra Pradesh Criminal Investigation Department (CID) has arrested the law student, Chaganti Rahul Reddy of Arundalpet in Guntur district, on charges of promoting enmity and hatred between different groups.

The police said his Facebook post was "irresponsible and anti-people."

On October 18, the CID said, it had arrested another man Samudrala Uday Kumar of Secunderabad. Mr Uday Kumar had shared Mr Raul Reddy's post on his website. He spent a day in jail and was then released on bail. The police said they took time to track Mr Rahul Raddy; he allegedly removed his Facebook post after Mr Uday Kumar's arrest.

Mr Rahul Reddy is said to be a YSR Congress activist in his final year of law at a local college. The post is being seen as a political comment on Vishakhapatnam or Vizag voting for the BJP rather than the YSR Congress in the national elections earlier this year.

The CID's Andhra Pradesh chief Tirumal Rao said the police took a serious view of the post because "when such a big calamity happens, people can't poke fun or talk about it lightly, or post comments that create hostility between groups."

Cyclone Hudhud had hit Visakhapatnam on Sunday, October 12, flattening the key port city of Andhra Pradesh. 20 people died and there was extensive damage to property and infrastructure.

India's Role in the World's Largest-Ever Scientific Project

In southern France, more than 20 billion dollars are being spent on trying to make a first-of-its-kind nuclear reactor, a special steel cauldron where top scientists from countries including India hope to generate clean nuclear energy by fusing atoms, a process similar to what happens on the sun.

This is till date world's largest scientific project ever to be undertaken. The reactor will weigh about 23,000 tons - as much as three Eiffel Towers. Some 80,000 kilometres of special super conducting wires will be used.

The International Thermonuclear Experimental Reactor (ITER) brings together India, China, South Korea, USA, Japan, Russia and the European Union  as scientists see if they can jointly harness the power of the Sun by literally confining it in a steel bottle. The head of ITER, Dr. Osamu Motojima, points out that together these entities "represent half the world's population and account for two-third of the global economic might."

Nuclear plants today generate power by splitting the atoms and in doing so they produce large quantities of radioactive waste that can be dangerous for hundreds of years and has to be handled with extreme care. In contrast, 'fusion energy' generates power by joining two atoms into one; the usual raw material is hydrogen; and the  waste generated will largely be either helium, a benign noble gas, or  water.

That's why fusion energy is sometimes referred to as 'evergreen atomic energy'. According to Dr. Ravi Grover, head of the Indian delegation at ITER, 'fusion is inherently safe, there is no danger of an uncontrolled chain reaction and fears of a nuclear explosion are negligible, producing almost no long lived radioactive waste'.

Within the massive steel frame, gas will be heated to over 150 million degrees and it will be confined to a limited space. Using giant magnets, some atoms will then be forced to fuse together releasing huge amounts of heat which can then be directed to run turbines to generate electricity. In the first instance, it is hoped the fusion reactor will produce ten times more energy than what is used to initiate the reaction estimated to produce the equivalent of 500 MW of power.

For half a century, scientists have dreamt about accomplishing this feat, but it was only in 2006 when progress was made with the formation of the ITER.

Earlier this month, 800 top scientists from more than 35 countries gathered to take stock of fusion energy at the International Conference on Thermonuclear Fusion Energy in the picturesque town of Saint Petersburg, Russia. The mood was generally upbeat but there are worries that cost and time over-runs could spiral out of control in this mammoth exercise. Motojima admits there have been 'delays' and hopes that by next year, his team will be able to give a firm timeline for the completion of the ITER project.

The delay has already spooked the USA which is threatening to pull out of the global project, on being asked by us, Motojima said 'I have the confidence that  the US will never drop out of ITER' since according to him 'the fusion reactor has already passed the point of no-return.' 

 India is providing a tenth of the components for the massive nuclear complex unfolding at Cadarache in France. New Delhi is contributing what would, when completed in 2021, be the world's largest refrigerator. The cryostat acts like a thermos flask but operates at some of the coldest temperatures ever seen in the universe, working at minus 269 degrees Celsius. This is used to keep the special super conducting magnets at the cold temperature at which they need to operate; the entire fusion system would collapse if it can't be kept cold.

India is also expected to contribute about 9,000 cores over the next decade to the project, thus paying for a little under 10% of the total cost.

Ratan K. Sinha, Chairman of the Atomic Energy Commission, Mumbai says 'participation of India in the ITER project, with its immense scientific talent and industrial competence, has provided an opportunity to India to master cutting edge technologies.

Once the proof is established that mankind can harness the power of the Sun, India could well build its own fusion reactors after 2050 .

Black Money Case: Name All Foreign Bank Account Holders Tomorrow, Says Supreme Court

The Supreme Court, which is monitoring the attempts to recover untaxed or black money stashed abroad, has ordered the government to share by tomorrow the names of all Indians with foreign bank accounts.

"Why are you providing a protective umbrella to foreign bank account holders?" asked the judges. "We can't leave the issue of bringing back black money to government. It will never happen during our time," they added, stating that they will rely more now on a special committee of retired judges and regulators appointed by the Supreme Court to map the recovery of black money.

Both the previous government headed by Dr Manmohan Singh and the new government have argued in court that tax treaties with other countries prohibit the disclosure of names till charges are framed.

Finance Minister Arun Jaitley said the government will respect the court order and it will be upto the judges to determine whether to publicly disclose the list that will be furnished tomorrow. "There are 600 odd names in the list - we will give the  list in a sealed cover and I'm sure the court will take appropriate steps to maintain their confidentiality," said Attorney General Mukul Rohatgi.

Yesterday, the government named eight people in the top court who are being prosecuted for allegedly hiding undeclared cash in Swiss and other banks. Critics have accused the government of using tax treaties as a cop-out to shield rich and powerful citizens.

The government today said once it has completed investigations against Indians who hold bank accounts in countries like  Germany and Switzerland, it will provide all information to the Supreme Court.  "You do not do anything. Just pass on the information of account holders to us and we will pass orders for a further probe," said the frustrated court.

The Supreme Court has been monitoring the investigations into black money since 2009, based on a petition filed by noted lawyer Ram Jethmalani.

PM Modi a Good Communicator But Words Not Enough: Sheila Dikshit

Congress leader Sheila Dikshit has qualified her headline-making comment describing Prime Minister Narendra Modi as a "man with a vision". Today, she told us: "Vision means nothing if there is no change on the ground."

Mr Modi, she said, was a "good communicator but people have elected him for what he can do for them, not to hear him speak."

The former Kerala governor and three-time chief minister of Delhi was quoted by the Indian Express newspaper this morning as saying that when she met PM Modi in July, she saw a confident man with a vision and a new language.
 "I said when I met him I found him a confident man, a man who had a vision. But I said there was no visibility of the vision. There is talk, yes, everyday a vision is being given to the people, but no action is being taken," Ms Dikshit told us.

"I don't think I have said anything wrong. That was my impression of the man and I stand by it. But what he said five months ago, nothing has come on the ground. Have prices come down? Have all those people whose bank accounts were supposed to have been made public? All these are questions which everybody is beginning to ask," said the 76-year-old Congress veteran.

Ms Dikshit is the second Congress leader after Kerala MP Shashi Tharoor to appear appreciative of PM Modi, who took power in May after his party, the BJP, defeated the Congress-led UPA in the national election.

She sought to draw a distinction between her comments and those of Mr Tharoor, who was dropped as Congress spokesperson for what was seen as his "constant and unnecessary adulation" of PM Modi.

"The context is not same at all....yes he looked confident and seemed to have good vision. But all this vision he comes out with practically every day, every week, has yet to reach the people and unless people feel the vision is touching them, I don't think a vision is a vision," Ms Dikshit toldus.

Airbus And Tata Team Up to Bid For New Planes For Air Force

Europe's Airbus and Tata Sons have bid for a multi-billion dollar contract to replace the Indian Air Force's ageing fleet of AVRO cargo planes, as New Delhi looks to boost the role of the local private sector in modernising its armed forces.

Under the bid, estimated by analysts to be worth at least $2 billion or Rs. 12,200 crore, Airbus' Defence and Space unit and Tata's Advanced Systems would replace the 56 AVRO jets with Airbus' C295 transport planes, the European manufacturer said on Tuesday. 

 Airbus would supply the first 16 planes in "fly away" condition from its own assembly line, while the subsequent 40 would be manufactured and assembled by Tata Advanced Systems in India.

They would be the first military planes built by an Indian private company on Indian soil, with current manufacturing dominated by state-run Hindustan Aeronautics.

Prime Minister Narendra Modi and his government have raised the foreign investment limit in defence since coming to power in May, and are moving to clear a backlog of military equipment orders and close the gap on strategic rival China.

The goverment has said it will prioritise companies which have pledged to manufacture within India.

Indian companies such as Tata, Larsen & Toubro and Mahindra Group are spending billions of dollars to build arms, as they look to win a chunk of the $250 billion that analysts estimate India will spend on defence kit over the next decade.

The government first issued a tender for a foreign supplier and Indian private firm to replace the Avro jets in May 2012, but a lack of interest from potential bidders and ministerial infighting led to a series of delays.

India is trying to replace much of its outdated fleet of military planes. The biggest contract is a $15 billion deal with France's Dassault Aviation to buy 126 Rafale fighter jets, which is still to be finalised.

Black Money Names Selectively Released, Say Congress, AAP, Left

As the government today revealed three names in the Supreme Court in connection with untaxed or black money in foreign accounts, opposition parties alleged that the names had been released selectively to protect powerful people.

Former union minister Salman Khurshid of the Congress said, "Whatever names they have given, if they feel it's right then let them go ahead. We have no issues about the government releasing names. But selective naming should not be done."

The names revealed today are Pradip Burman of the Dabur India group, Rajkot-based bullion trader Pankaj Chimanlal Lodhiya and five members of Goa-based mining firm Timblo. In its affidavit to the court, the government said they are being prosecuted for tax evasion as unaccounted for money was found in their foreign accounts.

Arvind Kejriwal, the chief of the Aam Aadmi Party, said he had revealed the same names two years ago but the government was deliberately shielding powerful people on the black money list.

"We want the government to say whether all the names that we disclosed ear;ier are in the list or not. The list of all foreign account holders should be revealed and there should be uniform action against the guilty, " Mr Kejriwal said.

The government told the court this morning that it has no intention of withholding names and they would be revealed in cases where tax evasion was established.

Earlier, the government had drawn criticism for saying the names could not be revealed as tax treaties with other countries didn't allow it unless charges are framed in court. Finance Minister Arun Jaitley had then told us that names would be shared with the Supreme Court as and when investigations were completed and "some names will embarrass the Congress."

The Left questioned why no politicians' names had been revealed in court. "Where are the names that will embarrass the Congress party?" asked CPI leader D Raja.

On Government's Black Money List, People Who Allegedly Donated to BJP, Congress

Finance Minister Arun Jaitley told us recently that a revelation of names in connection with untaxed or black money in foreign accounts would "embarrass the Congress." While none of those in a first set of names placed by the government before the Supreme Court today are politicians, there is potential embarrassment for not just the Congress, but also ruling party BJP.

Among eight people named in an affidavit filed in the top court today are five members of a family that runs a Goa-based mining company Timblo Pvt Ltd. The Timblos have donated funds to both the Congress and the BJP, more to the latter, NGO Association for Democratic Reforms or ADR said citing public documents.

"An analysis of the donations made by individuals and corporates to the National Parties between FY 2004-05 and 2011-12 shows that Timblo Pvt Ltd, whose Managing Director is Radha Timblo, had donated nine times to BJP amounting to a total of Rs. 1.18 crores and thrice to INC, amounting to a total of Rs. 65 lakhs in seven years," ADR said in a press release, listing details of the donations.

The last of the alleged donations listed were made in 2011-12; state elections were last held in Goa in 2012.

The Timblos, along with Pradip Burman of the Dabur India group and bullion trader Pankaj Chimanlal Lodhiya of Surat are being prosecuted for alleged tax evasion as money was found in their foreign accounts that was unaccounted for, the government has said.

Timblo company's Radha Timblo conceded that "at different times there were some searches, raids" but said she would comment on the affidavit later.

Shiv Sena Sweet Talks BJP Which Preps For Friday Swearing-In

The BJP's endurance test for the Shiv Sena is delivering results. In new shows of courtesy, the Shiv Sena and its top leaders are offering vast praise for the BJP, the Prime Minister and the man likely to be Maharashtra's next chief minister, Devendra Fadnavis.

Sources confirm that on Friday, the BJP, which won the most seats in the state election, will have its ministers take their oath at a ceremony attended by the Prime Minister. The BJP does not have an outright majority, but it has a menu card of options for forming the government.



The BJP has an offer of support from Sharad Pawar's NCP;  it could recast its alliance with the Sena, which placed second in the elections; the BJP has also said it's working on winning over independents to bolster its strength.

Shiv Sena sources claim that their chief Uddhav Thackeray is "talking directly" with PM Modi and BJP chief Amit Shah to forge a deal.

So far, however,  the BJP has refused to put the Shiv Sena out of its misery by indicating whether a merger will be renewed. The Shiv Sena has made it clear that it treats the partnership as unstuck only in Maharashtra. Its law-makers were conspicuously present at a tea party hosted for allies by the PM on Sunday.

In an attempt at make-good, the Sena, in an editorial in its mouthpiece today, credited both the Prime Minister and Mr Shah for winning Maharashtra. Earlier editorials tolled the PM and his party with a marked lack of restraint.

"Fadnavis ji has done great work in Maharashtra," said Sanjay Raut of the Shiv Sena, promising his party's support for "a Chief Minister who will take Maharashtra to new heights."

Tomorrow, senior BJP leader Rajnath Singh is slated to be in Mumbai to attend a session where law-makers are expected to elect Mr Fadnavis as their leader and so the new Chief Minister.

India to Build 54 New Border Posts In Arunachal, China Reacts

China today warned India against taking any action that may "complicate or exaggerate" the boundary issue after India announced plans to build 54 new border posts in Arunachal Pradesh on October 24.

China's position on the boundary question is consistent and clear, said Chinese Foreign Ministry spokesperson Hua Chunying in an e-mail response to the news agency Press Trust of India. China, he said, was committed to finding a solution "through friendly negotiation as soon as possible" and working together to safeguard peace and tranquility.

 But "pending the final settlement of the boundary question, we hope the Indian side could refrain from taking any action that may complicate or exaggerate the question," Mr Hua said.

On October 15, China had objected to India's plans to build a 2000-km road along the border in Arunachal Pradesh. The road from Mago-Thingbu in Tawang to Vijaynagar in Changlang district is meant to match China's infrastructure development.

"Before the border problem is solved, we hope the Indian side will not take any action that could further complicate the relevant issue," Chinese Foreign Ministry Spokesman Hong Lei had said.

"We should jointly safeguard the peace and tranquility of the border area and create favourable conditions for the final settlement of the border issue," he had added.

In response, Home Minister Rajnath Singh had said nobody should "threaten or warn India". "India has grown in strength. Both sides should resolve the border issue through dialogue," he had said.

Subsequently, officials from India and China held the Working Mechanism for Consultation and Coordination held a meeting in New Delhi, during which the two sides discussed a host of issues relating to the management of the boundary and keeping peace along the border.

Last month, India and China agreed to pull back troops ranged against each other in Ladakh, ending their biggest face-off on the border in a year.
